Makerly Privacy Policy

This Privacy Policy explains how The Wavering Line LLC, a Kansas limited liability
company operating Makerly (“Makerly,” “we,” “us,” or “our”), collects, uses,
shares, and protects information when you use the Makerly mobile application,
hosted web app and public market pages, usemakerly.com,
and related services (collectively, the “Services”).

1. Information We Collect

Information You Provide

We may collect:

  • Account information, such as name, email address, role, and login credentials.
  • Host information, such as organization details, market listings, schedules,
    locations, fees, application questions, cover photos, logos, exported roster
    activity, and Stripe connection status.
  • Vendor information, such as business name, description, location, links, images,
    application contact email, application answers, booth photos, and application
    status.
  • Communications, support requests, outbound email delivery records, and payment
    confirmation email records.
  • Records of acceptance of our Terms of Use and Privacy Policy.

Payment Information

Payments are processed by Stripe. Makerly does not store full payment-card numbers.
We receive transaction details such as payment amount, status, type, Stripe
identifiers, platform fee, refund status, and payment timestamps. Stripe processes information under its own
privacy policy.

Information Collected Automatically

We may collect device and technical information, app interactions, diagnostics,
IP address, notification tokens and preferences, and security or fraud-prevention
signals. If location-based discovery is enabled, we may use the home city or region
you provide; the current Services do not require precise background location.

2. How We Use Information

We use information to:

  • Provide, maintain, personalize, and improve the Services.
  • Create accounts and authenticate users.
  • Publish markets and vendor profiles according to user settings.
  • Process and track applications, decisions, payments, refunds, payment
    confirmations, and notifications.
  • Enable hosts and vendors to communicate through application workflows.
  • Enable hosts to export applicant and accepted-vendor lists and contact vendors
    about application updates and future market opportunities.
  • Provide customer support.
  • Protect users, prevent fraud, secure the Services, and enforce our Terms.
  • Comply with legal obligations and establish or defend legal claims.
  • Analyze usage and develop new features.

3. How We Share Information

We may share information:

  • Between hosts and vendors. Hosts can view information submitted in
    applications to their markets, including the application’s contact email. Hosts
    may export applicant and accepted-vendor information for market administration
    and future market-related contact. Vendors can view relevant host and market
    information.
  • Publicly. Published market listings and published vendor-profile information
    may be visible to users or the public.
  • With service providers. We use providers such as Supabase for backend
    infrastructure and file storage, Stripe for payments and connected accounts,
    Brevo for transactional email delivery, Vercel or similar providers for web
    hosting, Apple for app distribution and push notifications, and vendors
    supporting hosting, security, analytics, and support.
  • For legal and safety reasons. We may disclose information to comply with law,
    protect rights or safety, investigate fraud, or enforce agreements.
  • In a business transaction. Information may transfer in connection with a
    merger, financing, acquisition, reorganization, or sale of assets.

We do not sell personal information for money. We do not share personal information
for cross-context behavioral advertising as those terms are commonly defined in
U.S. state privacy laws.

4. Data Retention

We retain information for as long as reasonably necessary to provide the Services,
comply with legal and accounting requirements, resolve disputes, enforce
agreements, and protect the Services. When an account is deleted, Makerly removes
the account and associated profile, application, photo, and solely owned market
data. We may retain limited completed or refunded payment records and Stripe
transaction identifiers, without profile or application content, for up to seven
years for financial, tax, fraud-prevention, and dispute purposes.

Hosts and vendors may retain information they receive through the Services under
their own policies and legal obligations. Makerly does not control those independent
retention practices.

5. Your Choices and Rights

You may update certain account, host, vendor, and notification information in the
app. You may permanently delete your Makerly account from the Profile screen after
confirming your password. You may also request access, correction, deletion, or a
copy of your personal information by contacting us. We may need to verify your
identity and may retain information where required or permitted by law.

Depending on where you live, you may have additional privacy rights, including the
right to appeal a denied request. We will not discriminate against you for
exercising applicable rights.

You can disable push notifications through device settings and manage available
notification preferences in the Services. Transactional emails, such as account,
application, and payment confirmation emails, may still be sent when needed to
provide the Services.

You may ask a host to stop sending future market-opportunity emails. Hosts are
responsible for honoring applicable opt-out requests and marketing laws.

6. Security

We use reasonable administrative, technical, and organizational safeguards designed
to protect information. No system is completely secure, and we cannot guarantee
absolute security. Keep your password confidential and notify us if you suspect
unauthorized account access.

7. Children’s Privacy

The Services are not directed to children under 13, and users must be at least 18
years old. We do not knowingly collect personal information from children. Contact
us if you believe a child has provided information to us.

8. International Use

Makerly is operated from the United States. If you access the Services from another
country, your information may be processed in the United States and other locations
where our service providers operate.

9. Third-Party Links and Services

The Services may link to third-party websites or services, including host websites,
vendor websites, Stripe, and social platforms. Their privacy practices are governed
by their own policies.

10. Changes to This Policy

We may update this Privacy Policy. If changes are material, we will provide
reasonable notice and may require acceptance of an updated version. The effective
date above identifies the current version.
